To receive these communications you must opt in, and you may opt out at any time by following the instructions at the bottom of our newsletters, managing your subscription in your online account, or contacting customercare@worldofmisha.com. It may take up to 48 hours for your status to update.

Your Rights

The GDPR provides rights of access, modification and deletion of your personal information. Please submit any rights request to customercare@worldofmisha.com. Your rights include the right of access, rectification, portability, erasure (“to be forgotten”), restriction of processing, and the right to object.

Legal Agreement

These are the terms and conditions by which we agree to supply any of the products listed on our website. By entering www.mishaworld.com and purchasing products from MISHA Collection through the website, you accept these Terms without modification and agree to be bound by them. If you do not wish to be bound by the Terms, you should not purchase products from the website.

We reserve the right to modify the Terms at our absolute discretion from time to time without individual notice. You will be deemed to have accepted any modifications if you continue to purchase products after the amended Terms have been posted. Any queries may be directed to customercare@worldofmisha.com.

Eligibility

You must be over the age of 18 to place an order through the website. If you are under 18, you may only use this website with the consent and involvement of a parent or guardian.

Purchase Contract

An order constitutes an offer to us to purchase the specified products, and remains open until we accept or decline it. Any acknowledgement of your order is for the purpose of providing an order reference and is not acceptance. On completing an order you must pay in full by supplying valid card or PayPal details, and you warrant that all information supplied is correct.

We are not obliged to supply products until payment is received in full. Our acceptance of your offer comes into effect when your order has been dispatched and a confirmation email has been sent. Nothing in these Terms affects your statutory rights — including the right that products correspond to their description, are fit for purpose and of satisfactory quality.

Price

Prices quoted on the website are indicative and subject to change. All prices are inclusive of GST and exclusive of postage and packing, a summary of which is on the Shipping page. The final purchase price payable is the amount specified at the end of the order process, including GST and applicable delivery charges. The first-customer discount code is valid for full-price items only and excludes pre-order items.

Delivery & Availability

All products are subject to availability; we will notify you and refund any payment if a product is unavailable when processing your order. We provide an estimated delivery date and use best endeavours to meet it, but cannot guarantee delivery on that date. You are responsible for ensuring you are available to receive the products. We are not liable for delays due to causes beyond our reasonable control, including an unreasonable refusal to accept delivery or a delay on behalf of the carrier.

Returns

On delivery you must inspect the products as soon as reasonably practicable. We accept returns strictly in accordance with our Returns Policy. Products not dealt with under the Returns Policy are deemed to be in accordance with the order, free from defects apparent on reasonable examination, and accepted by you.

Cancellation

We reserve the right to cancel an order if a product is unavailable for any reason; if we do, we will notify you and refund any payment using your original payment method. You cannot vary or cancel an order without our prior written consent — to request cancellation, please write to customercare@worldofmisha.com.

Title & Risk

Title and risk in the products pass to you when the products are delivered to you or are in your possession, whichever occurs first.

Liability & Consumer Guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have products repaired or replaced if they fail to be of acceptable quality where the failure is not major.

To the extent permitted by law, and other than as set out above, products are provided without further express or implied warranty, and our liability is limited (at our option) to the replacement or repair of the products, or the cost of doing so. We are not liable for incidental, indirect or consequential loss, including loss of profit or revenue.

Governing Law

These Terms are governed by the law in force in the State of Victoria. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from them. Any provision that is unenforceable is to be severed to the extent necessary to make these Terms enforceable.
